Smoke Anywhere Stealing money from my account and false advertising -- Posted: 2009-10-10
This was advertised as a Risk Free Trial Program. I signed up and authorized them to take the $9.95 shipping and handling from my bank account. I could return the product if I chose to, by requesting a Return Authorization Number. They refuse to respond to that request, the terms of the transaction have now changed and there is no way to contact them. They are going by numerous names such as EZ Smoker & Smoke Anywhere USA, and when I tried to call the other number, the representative denies the affiliation. They have taken $89.95 and $29.95 as well as the agreed upon $9.95 but these amounts have been taken by two different companies that they claim are not affiiated. How can this be? I finally had to close my bank account. This is one of many such complaints so I doubt it was only my mistake. This is a fraud and scam and should be stopped. Maybe we should get a class action law suit going.

The exact same thing is happening to me. As a matter of fact I can not even contact them because the phone number they provide to my bank is bogus. I just received another $29.95 charge today. I don't know what to do about it. I will contact my bank today to do something. If anyone has any ideas please let me know.

Reported By Rand (Las Vegas, Nevada) -- Smokingeverywhere Try our new Electronic Cigarette for free, We'll only Charge you a hundred dollars, whether you want ot or not
Ad's says pay shipping and handling of $9.95 The product is (Free) - email is then sent (I found mine in my Yahoo spam folder) that you must call their number and "qualify for their promotion. I did not call right away so they called me two days later. said the $9.95 was for S&H and the product cost $99.95 - I could try it for 14 days and send it back (at my expense) and I would only be out the original $9.95. If I decide to purchase immediately I could buy it for $69.95. I told them I would try the 14 day deal and did not want any other offer. they verified my shipping address and I was fine with that. 3 days later I get another call and to go through the whole process again. I told them I already talked with someone and didn't need to (re-register), then 3 days later I got another call, this time they said the product was shipping the following day and wanted to know if I wanted to buy the product upfront I told them no. 3 days later I get yet another call telling me the product would be shipped out the following day. by this time I just told them to cancel the entire deal and don't send anything and refund my $9.95. 3 days later I received the product in the mail with an invoice that totaled over $100.00 with more shipping and handling. I tried the product and was not satisfied (I have tried similar products for reference) but was informed that I could not return it even if less than 14 days, the EULA says once I had used the product it cannot be returned, and would be charged on my card the entire amount of the invoice. the original @9.95 was charged against my account the day I placed the order. the 14 days started the day they send it (The man on the phone told me) - You can not get back to them via their 800 number and/or their automated phone. they did not respond to any emails. I registered with their company a member and was sent return emails immediatly (might have been automated too) since 4 agents spoke with me and none of them knew the other one had already spoken with me. I'll continue to file complaints via email and phone (If I ever Get on with them) and keep you informed.
And Mike Of Camarillo, California reported:
smoking everywhere - electronic cigarette.com Free trial, not so free..plus fraudulent charges
I ordered the free trial for $9.99 and I never received it. I tried calling and emailing them but was unable to get ahold of anyone and didn't receive and email reply. I called the credit card company and had the charges reversed. The following month I received a charge for $99.00 on my account from the same company. I called and disputed that charge as well and had it reversed. I also told them not to let this company charge to my account anymore and Chase Visa told me, no problem.
Then next month I receive 5 emails saying they have posted a credit for $49.99 to my account. The next day there were 5 charges on my credit card each for $49.99 from smoking everywhere. I once again called my credit card company to dispute them and then I closed my account with them since they are unable to efficiently stop future charges. They said if I got a new card with a new number that the company charging my account could legally find the replacement card number and use that on instead. How can that be legal? Anyway, I wish someone would prosecute this company and put them out of business.
